Abstract

More and more applicants fail to obtain registrations for colour marks, in particular colour combination marks. What could be the reason for this? Is perhaps the law too restrictive? Do applicants simply fail to claim the marks properly? Maybe both?

In light of some recent decisions by courts and competent authorities in Europe, the talk will revolve around more general issues relating to the absolute grounds for refusal of registration.

Apostolos is a Senior Lecturer in Intellectual Property Law at QML.
