Abstract: This talk will first explain what IP overlaps are and what issues they raise namely overprotection and restriction of competition, resulting or not of regime clashes. Thereafter, the presentation will examine the overlap between copyright and trademark law from a EU perspective. It will show that EU law regulates this overlap only in part and those unregulated aspects can potentially pose problems. It will conclude by proposing solutions to these problems.
