Speaker: Christopher Knight, 11 King's Bench Walk 

Biography: Christopher is a well-established junior with a broad public law practice and a particular specialism in media and privacy law and in Brexit-related matters. He has appeared in the most significant constitutional law cases of the last few years, including the Article 50 Brexit case, the first Scottish devolution reference and the challenge to the prorogation of Parliament. He has carried out a significant amount of advisory and litigation work in relation to the coronavirus pandemic and has acted as sole advocate before the High Court, Court of Appeal and the Court of Justice of the EU. He is a leading expert in information and data protection law and a highly regarded academic writer, publishing widely in journals. 

Abstract: Courts are used to balancing the incommensurable rights to freedom of expression and privacy under Articles 10 and 8 of the ECHR. But in the context of data protection, the exercise is, in principle, different. The rights arising from data protection are focussed, and derived from a specific legislative framework. Personal data may or may not be private information. The recognition of the importance of freedom of expression is, in contrast, vague and generalised. This presentation will explore the extent to which a balance is struck, looking at the case law on the right to be forgotten, the special purposes exemption and the use of the accuracy principle.
