Title: 'FRAND: Where are we? And where are we going?'

Speaker: David Webb, Herbert Smith Freehills 

Biography: 

David Webb is an associate in the IP team at Herbert Smith Freehills, specialising in patent litigation. With a first class master's degree in Natural Sciences, focussing on physics and chemistry, he has worked on high profile patent litigation before the English High Court involving highly technical expert evidence. David has experience in high tech patent disputes in a range of fields – including telecoms, diagnostics and semiconductors. He takes a particular interest in disputes around fair, reasonable and non-discriminatory (FRAND) licensing.

Abstract: 

In 2020 the Supreme Court issued a landmark judgment in the Unwired Planet case, confirming that the UK courts have jurisdiction to determine global fair, reasonable and non-discriminatory (FRAND) patent licence terms. Since then there has been a stream of FRAND litigation passing through the UK courts, along with the courts of a number of other jurisdictions – notably China, the US and Germany – leading to some high profile jurisdictional tussles. David Webb discusses the current state of play in the world of FRAND litigation and where it may be heading.
