The European Copyright Society (ECS) recently issued two Opinions on important copyright cases before the CJEU. Professor Bently led the drafting committee for the Opinion in relation to Case 476/17, Hutter v Pelham, which concerns questions referred by the German Federal Court of Justice in a case involving use of a sample from a sound recording by German electronic Kraftwerk. Professor Bently is a signatory to the Opinion in Case C-310/17, Levola Hengelo, in which the Court of Appeal of Arnhem seeks advice in a case in which protection is claimed for the taste of a cheese.
