Speaker: Ashton Chantrielle, 8 New Square
Biography: Ashton’s IP practice includes copyright, design rights, trade marks and passing off cases and she acts for a number of media clients. Ashton has considerable experience in both the Intellectual Property Enterprise Court and the High Court, while also acting regularly for clients at hearings and for appeals in the UK IPO and the EUIPO. Ashton has also acted in a number of cases that involve pharmaceutical brands, including the recent high profile case Glaxo Wellcome UK Ltd (t/a Allen and Hanburys) v Sandoz Ltd [2019] EWHC 2545 (Ch) concerning coloured asthma inhalers.
Abstract: Ashton was involved in the Martin v Kogan saga which related to a dispute about authorship of the screenplay for the film Florence Foster Jenkins. The case, which started in the Intellectual Property Enterprise Court, was successfully appealed and sent back for a retrial which took place in November 2020. Ashton will discuss the implications of the decisions including the impact of the Court of Appeal’s decision on the law of joint authorship under English law and the impact of the retrial decision on the importance of evidence.
